Spain Clears Legal Path for Carles Puigdemont’s Return

A major development in Spain’s long-running Catalan independence case has removed a key legal obstacle to the return of former Catalan president Carles Puigdemont.

On October 6, Spain’s Constitutional Court ruled that the 2024 amnesty law should cover the embezzlement offence connected to the Catalan independence movement. The ruling effectively rejected the narrower interpretation previously adopted by the Supreme Court, which had refused to apply the amnesty to Puigdemont and other leaders accused of misusing public funds.

The legal consequence was immediate. Following the Constitutional Court’s decision, the Supreme Court lifted the national arrest warrant against Puigdemont, meaning he can now return to Spain without facing arrest under that warrant. However, the amnesty has not yet been formally applied to his individual case, leaving a further judicial step before the criminal proceedings are fully resolved.

The dispute has involved several layers of law. Spain’s Constitutional Court had to determine how the amnesty legislation should apply, while the EU’s top court had already ruled in July that the Spanish amnesty law was compatible with EU law.

The case therefore represents more than a political development. It is a significant test of constitutional review, criminal liability, parliamentary amnesty and the limits of judicial interpretation—with the final application of the amnesty now moving back to Spain’s courts.
